Official Rules of the Prize Game

1. Organizer of the Prize Game

The organizer of the prize draw, which will be conducted among individuals registered on the email recipient list “Sign up for the mailing list and get a chance to win a pair of new ACE skis,” is Elan d.o.o., Begunje na Gorenjskem 1, Begunje na Gorenjskem, Slovenia, Company Registration No.: 1304836000 (hereinafter: “Elan d.o.o.”).

Participation in the prize draw, as well as winning and claiming a prize, is not conditional upon the purchase of any product. The official rules of the prize draw are available for review on the website: https://elansports.com/official-rules-win-a-pair-of-ace-skis.

2. Eligibility

Employees of Elan d.o.o., its affiliates, distributors, retailers, subsidiaries, advertising and promotion agencies, and suppliers (collectively, “Employees”), as well as their immediate family members and/or persons living in the same household as Employees, are not eligible to participate in the prize draw.

3. Agreement to the Rules

A condition for participation in the prize draw is that the participant agrees to these general terms and conditions and the official rules of the prize draw (hereinafter: the “Rules”). By participating in the prize draw, the participant is deemed to have fully accepted the Rules. Participation in the prize draw and receipt of a prize are not conditional upon the purchase of any product.

Furthermore, you agree to accept the decisions of Elan d.o.o. regarding all matters related to the prize draw as final and binding.

4. Duration of the Prize Draw

The prize draw will run from February 9th, 2026, starting at 5:00 PM Central European Time (CET), and will end on February 18th, 2026 at 12:00 AM in Central European Time (CET). Elan d.o.o. reserves the right to terminate the prize draw early if it decides to discontinue it, or to extend it with a new end date.

Participants will be informed of any changes in a timely manner via https://elansports.com/. No appeals against decisions are possible. All decisions of Elan d.o.o. regarding any questions related to the prize draw or the interpretation of these Rules are final and binding on all participants.

5. How to Participate

The prize draw will take place at https://elansports.com/ace-skis-ski-better-ski-ace, where participants will recognize it by the call to action “Sign up for the mailing list for a chance to win a pair of skis.”

Each participant who wishes to take part in the prize draw must, during the prize draw period, meet the following requirement:

• Sign up to the email mailing list with a valid email address via https://elansports.com/ace-skis-ski-better-ski-ace.

By fulfilling the above condition, the participant enters the prize draw. Entries must meet all requirements specified in these Rules to be eligible for a prize. Entries that are incomplete or do not comply with the Rules or specifications may be disqualified at the sole discretion of Elan d.o.o.

If a participant uses fraudulent methods or otherwise attempts to circumvent the Rules, the entry may be excluded from the prize draw at the sole discretion of Elan d.o.o.

6. Prizes

One (1) pair of Elan ACE SL11 W skis 2026/27 (priced at 749,95€) with bindings will be awarded. The selected winner will receive one prize only.

The actual/estimated retail value may vary at the time the prize is awarded. Prize details are determined solely by Elan d.o.o. No cash or other substitute prize is permitted. The prize is non-transferable.

The winner is solely responsible for all costs associated with the prize, including all international, national, and/or local taxes. No substitution of the prize, transfer/assignment of the prize to another person, or request for a cash equivalent is permitted.

By accepting the prize, the winner grants Elan d.o.o. the unrestricted right to use the winner’s name, details, and entry for advertising and commercial purposes without further compensation, unless prohibited by law.

7. Taxation

Participants are aware that the prize won may be subject to taxation under applicable tax legislation, including the Personal Income Tax Act (Official Gazette of the Republic of Slovenia, No. 13/11, as amended; hereinafter: ZDoh-2), applicable in the Republic of Slovenia. If required, Elan d.o.o. will pay an advance income tax on the main prize in accordance with applicable law.

Accordingly, winners agree that, if necessary and in accordance with the Tax Procedure Act (Official Gazette of the Republic of Slovenia, No. 13/11, as amended; hereinafter: ZDavP-2), they will provide Elan d.o.o., as the prize payer, with the following information within eight (8) days of receiving notification of the prize: full name, permanent address, tax number, and tax office.

If the winner fails to provide this information within the required time limit, they are not entitled to claim the prize. In such cases, the organizer is released from all obligations arising from these Rules toward the winner. The odds of winning depend on the number of eligible entries received.

8. Selection and Notification of Winners

The prize winner will be selected by random draw under the supervision of Elan d.o.o., no later than one (1) day after the end of the prize draw. Winners will be notified by email within a maximum of eight (8) days after the draw.

Elan d.o.o. assumes no responsibility if a winner does not receive notification due to spam filters or other security settings, or due to incorrect or otherwise inappropriate contact information provided by the winner.

If a selected winner cannot be contacted, is found to be ineligible, fails to claim the prize within three (3) days from the date the notification was sent, or does not return a completed declaration as required, the prize may be forfeited and an alternate winner may be selected. Compliance with all applicable regulations is a condition for awarding the prize.

9. Rights Granted by Participants

By entering this prize draw, you confirm and agree that Elan d.o.o., or anyone acting on its behalf, as well as its licensees, successors, and assigns, has the perpetual, worldwide right, within the limits of applicable law, to use, distribute, broadcast, publish, and/or print in any media your entry, name, responses, statements about the prize draw, and personal data for informational, commercial, advertising, public relations, and promotional purposes without additional compensation, notice, review, or consent.

By submitting such content, you represent and warrant that your entry is original and does not infringe any proprietary or intellectual property rights of third parties. If your entry infringes the intellectual property rights of another person, you may be disqualified at the sole discretion of Elan d.o.o.

If your entry constitutes an infringement of any proprietary or intellectual property rights of a third party, you agree to defend or settle such claims at your own expense and to indemnify and hold harmless Elan d.o.o. against any claims, proceedings, liabilities, losses, or damages, and to reimburse all costs incurred by Elan d.o.o. as a result of such infringement or alleged infringement.

10. General Conditions of the Prize Draw

Elan d.o.o. reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the prize draw at any time if viruses, bugs, unauthorized human intervention, fraud, or other causes beyond the control of Elan d.o.o. affect the administration, security, fairness, or proper conduct of the prize draw.

In such cases, Elan d.o.o. may select the winner from all eligible entries received before and/or after (if applicable) the action taken.

Elan d.o.o. reserves the right, at its sole discretion, to disqualify any individual who tampers with or attempts to tamper with the entry process or the operation of the prize draw or website, or who violates these Rules.

Elan d.o.o. has the right, at its sole discretion, to maintain the integrity of the prize draw and to void entries for any reason, including the use of robots, macros, scripts, or other technical means of entry.

Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the prize draw may constitute a violation of criminal and civil laws. Should such an attempt occur, Elan d.o.o. reserves the right to seek damages to the fullest extent permitted by law.

11. Limitation of Liability

By entering, you agree that you will not assert any claims against Elan d.o.o. and/or its subsidiaries, distributors, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, and/or directors for any illness, injury, death, loss, dispute, claim, or damage that may occur, directly or indirectly, whether due to negligence or otherwise, arising from:

• (i) participation in the prize draw and/or acceptance, possession, use, or misuse of any prize or any portion thereof;
• (ii) any technical malfunctions, including but not limited to failures of any computer, cable, network, hardware, or software;
• (iii) unavailability or interruption of transmissions or telephone or internet services;
• (iv) unauthorized human intervention in any part of the entry process or the promotion; or
• (v) electronic or human error in the administration of the promotion or the processing of entries.

12. Release and Assumption of Risk

Participants enter the prize draw or event at their own risk. Participants confirm that they are familiar with the sport of skiing, possess the appropriate knowledge and ability to participate, and fully understand and accept the inherent risks associated with the sport.

Unless expressly stated otherwise in these Rules, Elan d.o.o. does not provide any special safety measures or equipment. The sponsor is not responsible for any accidents or injuries that participants or their companions may suffer at the event.

Participants must follow standard instructions and limitations applicable to the sport and are responsible for their own safety. In this regard, participants agree to indemnify and hold harmless Elan d.o.o. from any claims, demands, legal actions, damages, or costs arising in connection with the participant’s use of Elan equipment and/or participation in the event.

Participants also agree to maintain adequate health insurance and not to seek reimbursement from Elan for any medical expenses or other damages related to injury.

13. Disputes

This prize draw is governed by the laws of the Republic of Slovenia, excluding conflict-of-law rules. As a condition of participation, participants agree that any disputes related to this prize draw that cannot be resolved amicably shall be resolved individually, without resort to class actions, exclusively before the competent court in Slovenia.

In any case, damages in such disputes shall not exceed the actual costs incurred by the participant in connection with participation in the prize draw (i.e., reasonable out-of-pocket expenses directly related to entering). Participants waive any claims for indirect, incidental, or consequential damages, including attorneys’ fees, and any right to have damages multiplied or increased.

15. Winners List

To obtain information about the winners or a copy of these Official Rules, send a request together with a self-addressed, stamped envelope to: Elan d.o.o., Begunje 1, 4275 Begunje na Gorenjskem, Slovenia.

Requests must be received no later than three (3) days before the event or the start of the prize draw.

16. Sponsor

The sponsor of the prize draw is Elan d.o.o., Begunje 1, 4275 Begunje na Gorenjskem, Slovenia.

17. Acceptance of Rules

By entering this prize draw, you confirm that you have reviewed, understood, and agreed to these Official Rules.
