1. General information
These Terms of Service govern the use of elansports.com and the purchase of products through the ELAN online store.

By placing an order, customers agree to the applicable Terms of Service presented during the purchasing process.
2. Scope of application
These Terms apply to users of the website and to purchase contracts concluded through the ELAN online store.
ELAN may amend these Terms from time to time. The version applicable at the time of order placement applies to that purchase.
Nothing in these Terms excludes or restricts mandatory consumer protection rights under applicable law.
3. Products and availability
ELAN strives to ensure that product descriptions, prices, specifications and availability are accurate and up to date.
Products are subject to availability. If a product becomes unavailable or a material pricing or information error is identified, ELAN will contact the customer and provide an appropriate solution in accordance with applicable law.
Product photographs are illustrative. The characteristics of each product are described on its product page.
4. Ordering and contract conclusion
Customers select products, add them to the cart and complete the checkout process by providing the required information and selecting an available payment and delivery method.
Before submitting an order, customers can review the selected products, quantities, prices, applicable taxes and delivery costs.
A purchase contract is concluded when ELAN confirms acceptance of the order by email, in accordance with the applicable purchasing process.
Once an order has been confirmed, changes may not always be possible. If a customer identifies an error or requests a modification, they should contact info@elan.si as soon as possible.
This does not affect any statutory right to withdraw from the contract or other mandatory consumer rights.
5. Prices and payment
Product prices are displayed in the currency applicable to the customer's selected market. Taxes are included or displayed as required by applicable law.
Any applicable delivery charges, taxes and additional costs are displayed before the customer completes the purchase.
The available payment methods are shown during checkout and may differ depending on the customer's market and order.
Payments are processed through the payment methods and service providers made available during checkout.
ELAN may change product prices without prior notice. Price changes do not affect confirmed orders, except where otherwise permitted by applicable law.
6. Delivery
Products are delivered to the address specified during checkout or made available for collection where an eligible pickup option is offered.
Delivery methods, estimated delivery times and applicable shipping costs depend on the destination and product availability.
Estimated delivery dates may vary. ELAN will inform customers of significant delivery issues and provide remedies as required by applicable consumer law.

Nothing in these Terms excludes ELAN's statutory obligations concerning delivery, loss of goods or the transfer of risk to consumers.
7. Right of withdrawal and returns
Consumers purchasing online generally have the right to withdraw from a distance sales contract within 14 days of receiving the goods, without providing a reason, subject to applicable legal exceptions.
To exercise this right, consumers should notify ELAN of their decision to withdraw by contacting info@elan.si.
The conditions for returns, applicable deadlines, exceptions, return shipping costs and refunds are described in our Return and Refund Policy .
These terms do not limit any additional rights available to consumers under applicable law.
8. Legal guarantee of conformity and warranty
Statutory legal guarantee
Consumers purchasing goods from ELAN benefit from the statutory legal guarantee of conformity provided by applicable consumer protection legislation.
Under EU consumer protection rules, the seller is responsible for a lack of conformity that becomes apparent within at least two years from delivery. National legislation may provide additional protection.
Where goods do not conform to the sales contract, consumers may request repair or replacement free of charge. Under the conditions established by applicable law, consumers may also be entitled to a price reduction or termination of the contract and a refund.

Commercial manufacturer warranty
Certain ELAN products may also benefit from a commercial manufacturer warranty. Any such warranty is provided in addition to statutory consumer rights and does not replace or restrict them.

9. User obligations
Users agree to use the website lawfully and must not interfere with its normal operation or security.
Prohibited activities include:

- Using the website for unlawful or fraudulent activities.
ELAN may take appropriate measures against misuse of the website, subject to applicable law.

ELAN strives to ensure the reliability, accuracy and availability of the website. However, temporary interruptions, technical errors or inaccuracies may occur.
To the extent permitted by applicable law, ELAN is not responsible for losses arising solely from circumstances outside its reasonable control.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including mandatory consumer protection rights and statutory remedies relating to purchased goods.
12. Complaints and dispute resolution
ELAN aims to resolve customer complaints promptly and amicably.
Complaints may be submitted by email to info@elan.si or by post to ELAN's registered address, marked as "Complaint".
Where a dispute cannot be resolved amicably, the competent courts and available legal remedies are determined in accordance with applicable law.
ELAN does not currently recognize a specific out-of-court consumer dispute resolution provider as competent under the applicable Slovenian consumer dispute resolution framework.
This does not restrict consumers' mandatory rights or access to competent authorities and legal remedies under applicable law.
13. Governing law
These Terms are governed by the laws of the Republic of Slovenia.
This choice of law does not deprive consumers of mandatory protection afforded by the laws applicable to them under relevant consumer protection and private international law rules.
